Spousal Maintenance

Spousal Maintenance or Spousal Support, I can’t tell you how many times a week I’m asked about spousal support.  Many people think they are married, the home maker and they are entitled for spousal maintenance to only find out Texas is different.

Let’s take a minute to review the requirements for spousal maintenance,  the first and most important criteria is that your marriage lasted  for 10 or more years.  During the duration of the marriage one spouse worked & the other was a home maker.

Spousal maintenance will only be granted if you meet the 1st criteria plus  if spouse does not have enough resources to provide for his/her minimum reasonable needs.  Spousal maintenance usually continues for 3 to 7 years but does end upon remarriage, cohabitation or death.

I’m going to be blunt, if you are asking for maintenance the judge will expect you to be looking for employment.  This is called presumption and very important you are prepared.
